Social Security Disability
If you have a disability that is preventing you from working, you may be entitled to Social Security Disability. The Social Security Administration pays cash benefits to people who are unable to work for a year or more as a result of a disability. These benefits continue until the person is finally able to work again on a regular basis.
The single most important factor for being approved for disability benefits is the accumulation of medical records. Following medical treatment for the conditions that prevent you from working is the main way to prove you are eligible for benefits. But even if you have all your medical records you are not guaranteed to receive these benefits.
Social Security Disability is a legal decision that arises from the claimant’s medical information. The interpretation of that information by Social Security regulations is how a person is determined to be disabled. Other factors also contribute to this decision. The claimant’s age, education, work experience, compliance with medical treatment, and the extent of the treatment are all taken into consideration.
There is a five question, step-by-step process that determines if you are disabled.
- Are you working?
- Is your condition severe?
- Is your condition found in the list of disabling impairments?
- Can you do the work you did previously?
- Can you do any other type of work?
There are two types of programs that provide benefits based on disability. Social Security Disability Insurance (SSDI), which benefits are based on prior work. And Supplemental Security Income (SSI), which benefits are based on financial need. You can be eligible for SSI even if you have never worked or paid taxes under FICA.
Social Security Disability claims must be filed before a certain time. A social security disability lawyer can help you determine how much time you have left, and they can help you file your claim. By law, anyone may file for Social Security Disability benefits. However, statistics show that claimants who have legal representation win their benefits much more often than those who apply on their own.
